### Damaged Goods Policy ###
Every item is hand-crafted, rigorously inspected, and securely packaged before shipment.
In the rare event that your item arrives damaged during transit, you must report the issue within 48 hours of delivery with clear photographs of both the damaged item and the shipping box.
To resolve a transit damage claim, Newimage prop replicas offers two options:
1. Return for Refund/Replacement: The item must be securely packaged and shipped back to our return address provided via a tracked service.
Once the item is received and inspected, a full refund or replacement will be processed.
2. Digital Proof of Destruction: If returning the item is impractical, a refund or replacement will only be issued upon receiving photographic and video evidence of the item being permanently destroyed beyond repair (e.g., completely severed or structurally defaced), alongside a handwritten note displaying your Order Number and the current date. We do not offer partial refunds or "keep-as-is" discounts for items claimed to be heavily damaged.
NEWIMAGE PROP REPLICAS TERMS & CONDITIONS OF SALE Last updated: September 2026 These Terms & Conditions apply to purchases made from NewImage Prop Replicas (“we”, “us”, “our”) by customers (“you”, “your”). By placing an order with us, you acknowledge that you have read and understood these Terms & Conditions. Nothing in these Terms & Conditions is intended to exclude, restrict or override any statutory rights you have under applicable consumer law.
1. ABOUT OUR PRODUCTS NewImage Prop Replicas specialises in individually produced, handmade movie prop replicas and sculptures. Many of our products are created from original sculptures and may involve significant amounts of hand sculpting, mould making, casting, finishing, painting and assembly. Because our products are handmade, minor variations in finish, texture, surface characteristics, paint application and other handmade characteristics may occur. Such variations are not necessarily defects where the item remains consistent with its description and agreed specification. Where a product is described as handmade, individually sculpted or individually finished, you acknowledge that it will not necessarily have the exact uniformity of a mass-produced factory item.
2. ORDERS AND ACCEPTANCE An order placed through our website, social media, email or other sales channel constitutes an offer to purchase. An order is not considered accepted until we have confirmed acceptance of the order. We reserve the right to decline an order where there is a genuine and reasonable basis for doing so, including suspected fraud, payment irregularities, inability to fulfil the order, or circumstances in which we reasonably believe that accepting the order would expose the business to an unacceptable risk. If we are unable to accept an order that has already been paid for, any payment received for that order will be refunded. 1
3. PRODUCT DESCRIPTIONS AND PHOTOGRAPHS We make reasonable efforts to ensure that product descriptions, dimensions, photographs and other information are accurate. Photographs may have been taken under studio lighting or other controlled conditions. Colours may therefore appear slightly different depending on lighting, photography, display settings and individual monitors. Where dimensions are stated, minor manufacturing tolerances may occur. We will not treat a minor variation that does not materially affect the product's description, quality or intended purpose as a defect.
4. HANDMADE AND ORIGINAL SCULPTURES Where a product is advertised as being produced from an original sculpture, this refers to our own original sculpting and production process. Our products are collector pieces and should be handled accordingly. Unless specifically stated otherwise, our replicas are not toys and may contain delicate components, sharp edges, thin sections or other areas requiring careful handling. The customer is responsible for following any care, display, assembly or installation instructions supplied with the product.
5. PRICES AND PAYMENT All prices are stated in the currency shown at the time of purchase. Unless otherwise stated, full payment must be received before production or dispatch. We reserve the right to correct obvious pricing errors before an order is dispatched. If an obvious pricing error has occurred, we will contact you and give you the option of proceeding at the correct price or receiving a full refund.
6. DEPOSITS Where we offer a deposit or instalment arrangement, the amount and payment schedule will be agreed with you before the order is accepted. 2 A deposit may be used to cover materials, production preparation, labour and other costs associated with beginning your order. If you cancel a bespoke or commissioned order, any amount retained by us will be limited to amounts that we are legally entitled to retain, such as reasonable costs already incurred or other losses permitted by the applicable law. We will not rely on this clause to remove any statutory cancellation or refund rights that apply to you. Where a deposit is expressly described as refundable, it will be refunded in accordance with the agreed terms and applicable law.
7. PRE-ORDERS Pre-orders are orders placed before a product is ready for dispatch. Estimated production and dispatch dates provided for pre-orders are estimates unless a specific date has been expressly agreed as a contractual delivery date. Because our products are handmade, production times can vary. We will make reasonable efforts to keep customers informed of significant delays. If a pre-order is cancelled, the customer's entitlement to a refund will depend upon the nature of the order and applicable law. Where the order concerns a genuinely bespoke or personalised product, statutory cancellation rights may not apply in circumstances permitted by law. Where we are unable to fulfil a pre-order, we will provide an appropriate refund.
8. CUSTOM AND BESPOKE ORDERS Custom, personalised and bespoke work may include modifications to an existing product or the creation of a product specifically to a customer's requirements. Before beginning custom work, we may require written confirmation of the customer's requirements. Once production has commenced, changes requested by the customer may result in additional costs and/or changes to the estimated completion date. Where a customer requests substantial changes after work has commenced, we may require additional payment before continuing. 3 Genuinely bespoke or personalised goods may be exempt from the normal statutory 14-day cancellation right applicable to distance sales, depending upon the circumstances and applicable law. This exemption does not remove a customer's statutory rights if the product is faulty, not as described or otherwise fails to meet the requirements of consumer law.
9. DELIVERY We will provide an estimated delivery or dispatch timeframe when appropriate. Unless a different period has been expressly agreed, goods supplied to UK consumers through an online contract must generally be delivered within the period required by applicable consumer law. Once an order has been dispatched, tracking information will be provided where available. Delivery dates supplied by third-party couriers are outside our direct control. We cannot accept responsibility for delays caused by events outside our reasonable control, although this does not affect any statutory rights you may have.
10. INTERNATIONAL ORDERS We ship internationally where this service is available. International customers are responsible for ensuring that the product they are purchasing may legally be imported into their country. Unless expressly stated otherwise at the time of purchase, the customer is responsible for: Import duties Customs charges Local taxes Brokerage or clearance charges Customs administration fees Any other charges imposed by the destination country These charges are separate from the purchase price and shipping charge paid to NewImage Prop Replicas. We cannot guarantee the amount of any import duties or taxes because these are determined by the destination country and its authorities. Customers should check their country's import requirements before ordering. If a customer refuses delivery because of customs charges, this will not automatically constitute a valid reason for a full refund. • • • • • • 4 Any refund in such circumstances will be considered in accordance with the applicable contract and consumer law, including any costs or losses that we are legally entitled to recover.
11. CUSTOMS DELAYS International orders may be delayed by customs authorities. Such delays are outside our control. We will provide reasonable assistance with customs documentation where appropriate, but we cannot control customs clearance times or decisions made by customs authorities. We will not falsify, undervalue or misdescribe goods on customs documentation.
12. DELIVERY DAMAGE All products are inspected and appropriately packaged before dispatch. For higher-value products, we may photograph or video the product and packaging before the package leaves our premises. If your parcel arrives visibly damaged, we strongly recommend that you: Photograph the external packaging before opening it. Photograph any visible damage to the packaging. Photograph the internal packaging before removing the product. Photograph the product and any damage discovered. Retain all packaging materials. Contact us as soon as reasonably possible. Do not dispose of damaged packaging until we have advised that it is no longer required. We may require photographs, videos or other reasonable evidence to assist with investigating a delivery-damage claim. This does not remove or restrict any statutory rights you may have.
13. RETURNS — CHANGE OF MIND Where UK distance-selling legislation gives you a statutory right to cancel, you normally have 14 days from receiving the goods to notify us that you wish to cancel. You then normally have a further 14 days to return the goods. You do not normally need to provide a reason for exercising this statutory cancellation right. 1. 2. 3. 4. 5. 6. 5 The direct cost of returning goods will normally be the customer's responsibility where the law permits this and we have informed the customer of that responsibility before purchase. Goods must be returned safely and securely packaged.
14. CONDITION OF RETURNED GOODS Customers are entitled to handle goods to the extent reasonably necessary to establish their nature, characteristics and functionality, similar to what would reasonably be permitted in a shop. However, customers are responsible for any loss in value resulting from handling beyond what is reasonably necessary. When a returned item is received, we may inspect it to establish its condition. Where legally permitted, we may make an appropriate deduction from the refund where the item has been: Scratched Chipped Cracked Broken Marked Stained Painted or repainted Modified Drilled or cut Glued Disassembled Repaired or subjected to attempted repair Altered in any other way Returned with missing components Returned with missing accessories Returned with missing parts Returned in packaging that has been damaged beyond what is reasonably necessary for inspection The amount of any deduction will be based on the actual reduction in value attributable to the condition of the returned goods. We will not use this provision to impose arbitrary or punitive charges.
15. DELIBERATE DAMAGE AND ABUSIVE RETURNS We take fraudulent and abusive returns seriously. • • • • • • • • • • • • • • • • • 6 Where there is reasonable evidence that an item has been deliberately damaged, altered or misrepresented in an attempt to obtain a refund, we may investigate the circumstances before determining the appropriate remedy. Evidence may include, where available: Photographs taken before dispatch Video recordings made before dispatch Photographs of packaging Serial numbers or identifying marks Photographs supplied by the customer Courier records Packaging condition The condition of the returned product Communication relating to the claim Where permitted by law, deliberate damage or alteration may result in a reduction or refusal of a refund to reflect the resulting loss in value. Nothing in this section removes any statutory consumer rights. Where we reasonably believe that a claim involves fraud or deliberate deception, we reserve the right to take appropriate further action.
16. FAULTY OR NOT-AS-DESCRIBED GOODS Nothing in these Terms & Conditions affects your statutory rights concerning faulty, defective, unsafe, not-as-described or otherwise non-conforming goods. Consumers have legal rights where goods do not meet the required standards of quality, description or fitness for purpose. If you believe your item is faulty, please contact us and provide photographs or video where appropriate. We may ask you to return the product so that the issue can be inspected. Depending upon the circumstances and applicable law, the appropriate remedy may include repair, replacement, price reduction or refund. • • • • • • • • • 7
17. CUSTOMER DAMAGE, MISUSE AND MODIFICATION We cannot accept responsibility for damage caused after delivery by: Incorrect handling Accidental damage Dropping Impact Incorrect assembly Incorrect installation Incorrect storage Exposure to unsuitable temperatures or environments Exposure to moisture where the product is not designed for it Unauthorised modifications Painting or refinishing Drilling or cutting Adhesive failure caused by customer modification Attempted repairs Repairs carried out by third parties Failure to follow supplied instructions Where a customer modifies or attempts to repair an item, this may affect the available remedy where the modification or repair caused or contributed to the problem. This does not affect statutory rights that cannot legally be excluded.
18. RETURNS PACKAGING Returned goods must be packaged appropriately. Where a product was originally supplied in specialist protective packaging, customers should retain and reuse that packaging where reasonably possible. If the original packaging has been discarded, the customer must use suitable alternative packaging capable of protecting the item during return transportation. We strongly recommend tracked and insured return delivery for high-value products.
19. REFUNDS Where a refund is legally due, it will normally be made using the original payment method. For a statutory cancellation, we will process the refund within the period required by applicable law. • • • • • • • • • • • • • • • • 8 Where required, the refund will include the cost of the least expensive standard delivery option originally offered. Additional charges paid for an upgraded delivery service do not necessarily have to be refunded. Where the law permits a deduction for diminished value caused by excessive handling, that deduction may be made from the refund.
20. CHARGEBACKS AND PAYMENT DISPUTES We understand that customers may contact their bank or payment provider where they believe a transaction is incorrect or a genuine problem has occurred. However, customers are asked to contact NewImage Prop Replicas first wherever reasonably possible so that we have an opportunity to investigate and resolve the matter. If a chargeback or payment dispute is initiated, we may provide the payment provider with relevant evidence, which may include: Order confirmation Invoice Payment records Correspondence Delivery confirmation Tracking information Photographs of the product before dispatch Photographs or video of packaging Product identification information Photographs of returned goods Evidence relating to the customer's use or handling of the product We will respond to payment disputes honestly and in accordance with the applicable payment provider's procedures. Initiating a chargeback does not remove or replace statutory consumer rights, nor does it prevent us from providing evidence to the payment provider. Chargebacks can occur where, for example, goods were not received or were alleged to be not as described, and payment providers may impose their own dispute procedures and time limits.
21. FRAUDULENT TRANSACTIONS We reserve the right to investigate orders where there are reasonable grounds to suspect payment fraud, identity misuse, stolen payment credentials or other fraudulent activity. We may delay dispatch while reasonable security checks are undertaken. • • • • • • • • • • • 9 If a transaction cannot reasonably be verified, we may cancel the order and refund the payment. We will not discriminate against customers or refuse legitimate orders without a reasonable basis.
22. PROOF OF PURCHASE We may require reasonable evidence of purchase when dealing with returns, refunds, warranty claims or other after-sales matters. Examples may include an order number, invoice, receipt or other reasonable evidence.
23. OWNERSHIP AND RISK Unless applicable law provides otherwise, ownership of goods will transfer in accordance with the terms of the sale and applicable law. Nothing in these Terms & Conditions is intended to unlawfully transfer risk to the customer before the customer legally assumes responsibility for the goods.
24. EVENTS OUTSIDE OUR CONTROL We will not be liable for failure or delay caused by circumstances beyond our reasonable control. These may include, for example: Natural disasters Fire Flood Severe weather Transport disruption Courier disruption Customs delays Government action Import restrictions Supplier shortages Material shortages Power failures Significant equipment failure Industrial disputes Other events that could not reasonably have been prevented or anticipated Where such circumstances occur, we will make reasonable efforts to minimise the impact and keep customers informed. • • • • • • • • • • • • • • • 10
25. INTELLECTUAL PROPERTY Unless expressly agreed otherwise, NewImage Prop Replicas retains ownership of photographs, designs, original sculpting work, production methods, artwork and other intellectual property created by us. Customers may not reproduce, copy, manufacture from, commercially exploit or distribute our original designs or sculptures without our written permission. The purchase of a physical replica does not transfer ownership of our underlying intellectual property.
26. PHOTOGRAPHS OF COMPLETED WORK We may photograph completed products for quality-control, record-keeping, archival and business purposes. Where appropriate, photographs of completed work may also be used for promotional purposes. Where a customer's personal information or identity is visible in promotional material, we will handle that information in accordance with applicable privacy law.
27. COMPLAINTS If you have a complaint, please contact us directly first. We will investigate genuine complaints fairly and aim to resolve them as quickly as reasonably possible. Please provide: Your name Order number Description of the issue Photographs or video where relevant Any other information reasonably required to investigate the matter We ask customers to give us a reasonable opportunity to investigate and resolve a genuine problem before escalating the matter through a payment provider or other dispute process.
28. STATUTORY RIGHTS Nothing contained within these Terms & Conditions affects rights that cannot legally be excluded or restricted. • • • • • 11 In particular, nothing in these Terms & Conditions excludes or limits statutory rights relating to goods being faulty, not as described or otherwise failing to meet requirements imposed by applicable consumer law. If any provision of these Terms & Conditions conflicts with a mandatory legal requirement, the relevant legal requirement will prevail.
29. CHANGES TO THESE TERMS We may update these Terms & Conditions from time to time. The version applicable to your purchase will normally be the version in force at the time your order is accepted, unless a change is required by law.
30. GOVERNING LAW These Terms & Conditions are governed by the laws applicable to the relevant transaction and, where applicable, the laws of England and Wales. Where mandatory consumer protection legislation in the customer's country provides additional rights that cannot legally be excluded, those rights will continue to apply.
31.
